Appeals Process

  1. Both the complainant and respondent have a right to appeal for one of the following grounds:
    1. A procedural irregularity that affected the outcome of the matter;
    2. New evidence that could affect the outcome of the matter and was not reasonably available at the time the determination regarding responsibility or dismissal was made; or
    3. The Title IX Coordinator, investigator or decision-maker(s) had a conflict of interest or bias that affected the outcome of the matter.
    4. The sanction is disproportionate with the violation
  2. These appeals should be made in writing, within five (5) business days of receipt of the outcome.
  3. Appeals will be reviewed by individuals independent of the investigative and hearing processes.
    1. Student appeals will be reviewed by the Vice President of Student Affairs and Dean of Students when the respondent is a student,
    2. Employee appeals will be reviewed by the Vice President of Human Resources when the respondent is an employee.
  4. Appeal decisions will be rendered within five (5) business days.
  5. All decisions made upon an appeal is final.
