Judicial Board Procedures

JUDICIAL BOARD PROCEDURES

In the case of a student violation of academic integrity or code of professional conduct, the following procedures will take place:

  • The complainant files a written request for a Judicial Board hearing to the Assistant Dean.
  • The Assistant Dean determines, in conjunction with the Judicial Board Chair whether the complaint should go before the Judicial Board.
  1. The Assistant Dean will:
    1. Submit notice of violation complaint to the Judicial Board Chair with a copy to the student and the academic advisor.
    2. Assure that the student under review and the complainant(s) bringing the violation complaint submits relevant documentation to the Administrative and Project Specialist for Programs and Events 3 business days prior to the hearing date.
    3. Ensure that all submitted documentation is distributed by the Administrative Assistant to the Judicial Board Chair or co-chairs, the seated panel, the Dean, the Assistant Dean, the complainant(s), advisor and the student under review at least 3 business days prior to the Judicial Board panel review date.
    4. Assure that the Judicial Board process is conducted according to procedure.
    5. Submits all relevant documents for inclusion in student’s folder.
  2. The Judicial Board Chair or Co-Chairs will:
    1. Identify three faculty members and two student members from the Judicial Board to comprise the Judicial Board panel. Panel members are selected from the Judicial Board based on availability and rotating service. Judicial Board members with a conflict of interest in regard to the pending review will recuse him or herself from being seating on the panel.
    2. Assign one of the faculty panel members to serve as panel chair.
    3. Set a date and time for the Judicial Board panel review meeting within 10 business days during the academic calendar following notification of complaint by the Assistant Dean for Academic Affairs.
    4. Ensure that all panel members and the student(s) have copies of all documentation relevant to the review at least 3 business days prior to hearing panel. Hearing panel will be rescheduled if deadlines are not met.
    5. Collect all documentation from panel members after panel review and destroys duplicate copies.
    6. Assure that review process is conducted according to procedure.
  3. Procedure for Judicial Board Panel Review Meeting
    1. Panel meets privately and reviews procedures and complaint immediately prior to the meeting.
    2. Student under review and complainant(s) join the meeting.
    3. Student under review may bring one person for support (i.e., advisor, family member, peer, or significant other), but such person cannot be a legal representative or lawyer and may not speak for the student prior to or during the proceedings. The academic advisor is strongly encouraged to attend to support the student.
    4. Complainant(s) has opportunity to present his/her/their case: maximum 20 minutes.
    5. Student under review has opportunity to present his/her case: maximum 20 minutes.
    6. Panel has opportunity to ask questions to complainant and/or student under review.
    7. If, after the formal hearing the panel has additional questions to the complainant or the student, the panel will email the questions with a copy to the student. All correspondence will include the student with the opportunity for the student to respond.
    8. When panel feels fully informed all non-panel persons are excused.
    9. Panel deliberates and determines recommendations for specific sanctions or dismissal based on consensus.
    10. Deliberations are confidential.
  4. The panel chair must communicate the recommendation in writing to the Assistant Dean for Academic Affairs within 3 business days of the Judicial Board panel meeting.
  5. The Assistant Dean must communicate the decision in writing to the student within 10 business days of the Judicial Board panel meeting, with copies sent to the Dean, Program Director, complainant(s), the advisor and the student.
  6. Involved faculty/staff have no further responsibility in this action.
  7. All original written documents reside in the student’s file.
